Berbeceanu Wins €200K from Romania Over Illegal Arrest

Berbeceanu will receive compensation of 200,000 euros

The court decided that the Romanian state, through the Ministry of Finance, should pay Berbeceanu 200,000 euros in moral damages and over 150,000 lei in material damages. The amounts will be updated and will include legal interest from the date the action was filed.

“Admits in part the civil action filed by the plaintiff BERBECEANU TRAIAN, in contradiction with the defendant ROMANIAN STATE – through the MINISTRY OF FINANCE represented by the Timişoara Regional General Directorate of Public Finances – through the County Administration of Public Finances Hunedoara. It obliges the defendant ROMANIAN STATE – through the MINISTRY OF FINANCE to pay civil damages to the plaintiff BERBECEANU TRAIAN in the amount of 200,000 euros – the equivalent in lei on the date of payment at the BNR exchange rate, representing moral damages, as well as the amount of 152,252 lei as material damages, amounts that will be updated with the inflation rate on the date of payment, to which is added the legal interest calculated from the date of the introduction of the action, respectively 12.09.2024, and until their effective payment.”

Berbeceanu was remanded in custody for over 30 days in a case that later proved to be unfounded. The High Court of Cassation and Justice determined that his arrest was illegal.
