Freiburg (dpa / lsw) – A student from the Ortenaukreis failed in court with the demand for stricter corona protective measures. The Freiburg Administrative Court rejected a corresponding urgent application with a decision published on Monday from Monday (2K 2971/20).
With her application from September 11th, which is directed against the sponsoring authority of the school and the state of Baden-Württemberg, the pupil wanted all classrooms to be permanently ventilated. In addition, there should be a minimum distance of 1.5 meters in all classrooms. Wearing mouth and nose protection should be compulsory and air quality monitoring should be installed in all classrooms.
The state only violates its duty to protect if protective precautions are not taken at all or if the measures taken are obviously unsuitable or completely inadequate, the judges explained in the decision. However, such a case does not exist with the hygiene and distance rules laid down. Among other things, the classrooms must be ventilated every 45 minutes and a mask requirement applies outside the classrooms.
The decision is not yet final. The applicant can lodge a complaint with the Administrative Court of Baden-Württemberg in Mannheim within two weeks.
