In the end, customers probably have to pay for the bankruptcy of Germania!
Because even in the case of a future of the insolvent airline, they can stay at their expense! That said the temporary insolvency administrator Rüdiger Wienberg.
He dampened the hope that customers might completely replace the flights with a potential new investor. Wienberg: "Then the investor would lose from the start and certainly be overwhelmed."
▶ ︎ But what would be conceivable: a potential investor could, according to a discount idea, help the customer financially. "Ultimately, that's what the investor decides", said Wienberg.
At the beginning of February, the Berlin-based airline had a bankruptcy with nearly 1,700 employees. Since then, all aircraft remain on the ground. The airline flew above all destinations in the Mediterranean and had more than four million passengers a year.
More than a quarter of a million bookings affected
bitter: Customers who have booked a flight directly from Germania will not be reimbursed for their costs. According to Wienberg, they are contractual partners of the airline and the claims are thus covered by the bankruptcy legislation. More than a quarter of a million flight bookings must be affected.
▶ ︎ The situation is different when customers have booked with a tour operator. "Then customers still have the claim that the tour operator organizes the holiday flight for them," said Wienberg. Once the actual insolvency proceedings have started, customers must register their claims with him. The phase of the interim insolvency proceedings is still in full swing.
Purchase negotiations are ongoing
At the moment, negotiations are under way for the sale of large parts of the airline. Two offers for a large part of the route network as well as the maintenance and service area are available. Wienberg: "Now we are at the level that we develop the sales contract so that we can discuss it."
Insolvency legislation, a sale of the airline is only possible after opening insolvency proceedings. A court decides on the opening date on the basis of a report from the provisional curator.
