Former President Cristina Fernández de Kirchner argues visitation rules are an attempt to silence and humiliate her.
Cristina Fernández de Kirchner (CFK) is challenging the visitation restrictions imposed during her house arrest, claiming they are part of a politically motivated effort to silence her. Her legal team has filed an appeal, arguing the restrictions violate her civil rights.
According to CFK, the deployment of Federal Police and the erection of fences outside her residence were unwarranted. She stated the Ministry of security’s justification of preventing street closures was a pretext. CFK moved a planned rally to Parque Lezama to avoid confrontation, accusing the government of attempting to “generate conflict and chaos.” She also criticized Security Minister Patricia Bullrich, calling her a “great and absolute failed,” echoing similar sentiments about Mauricio Macri.
CFK’s legal team, Carlos Alberto Beraldi and Ary Llernovoy, have formally requested that the Federal Oral Court number 2 (TOF 2) disclose the provisions for the visitation system. They argue that requiring judicial authorization for each visit is unprecedented for individuals under house arrest.
“In more than 50 years of justice I never saw a household prison with visits,” said the judge Juan Ramos Padilla-.
CFK questioned the criteria for approving or denying visits, particularly those from international political figures like Luiz Inácio Lula da Silva. Her lawyers emphasized that prisoners retain all constitutional rights except those explicitly restricted through due process, citing a Supreme Court ruling.
The defense team anticipates a response from TOF 2 soon. If the court doesn’t ease the restrictions, they plan to appeal to the Chamber of Cassation and potentially the Supreme Court, concerned about political influence on the judicial process.
CFK’s legal team also highlighted the disparity in visitation rights compared to those of convicted repressors, many of whom enjoy greater freedom despite facing multiple life sentences.
