Chapter 1 General Provisions

Article 1 In order to strengthen the management of animal epidemic prevention activities, prevent, control, purify and eliminate animal epidemic diseases, promote the development of the breeding industry, prevent and control zoonotic infectious diseases, and ensure public health safety and human health, according to the “People’s Republic of China Animal Epidemic Prevention and Control” The Act, and other relevant laws and administrative regulations, and in light of the actual situation of the province, formulate these regulations.

Article 2 These regulations apply to animal epidemic prevention and its supervision and management activities within the administrative area of ​​this province.

Article 3 Animal epidemic prevention implements the policy of giving priority to prevention and combining prevention with control, purification and elimination.

Article 4 Local people’s governments at or above the county level shall lead the work of animal epidemic prevention in a unified manner, incorporate animal epidemic prevention into national economic and social development plans and annual plans, establish and improve animal epidemic prevention systems, strengthen animal epidemic prevention infrastructure and institutional team building, and fund animal epidemic prevention. included in the budget at the corresponding level.

The township (town) people’s government and the sub-district office shall implement the responsibility for animal epidemic prevention, organize the masses to do a good job in the prevention and control of animal epidemics in their respective jurisdictions, and the village (resident) committees shall provide assistance.

Article 5 The competent departments of agriculture, rural areas and fisheries of the local people’s governments at or above the county level (hereinafter collectively referred to as the competent departments of animal epidemic prevention) shall be responsible for the animal epidemic prevention work within their respective administrative areas according to their respective duties.

The development and reform, public security, finance, health, transportation, forestry, urban management, commerce, market supervision and management departments of the local people’s government at or above the county level and the customs shall do a good job in animal epidemic prevention within their respective responsibilities.

Article 6 Local people’s governments at or above the county level shall formulate and organize the implementation of animal disease prevention and control plans, incorporate the prevention and control of zoonotic infectious diseases into the public health system, and plan, construct, and implement simultaneously.

The competent departments of health, agriculture and rural areas, wildlife protection, etc. of the local people’s government at or above the county level and the customs shall establish an animal epidemic prevention cooperation mechanism, strengthen the prevention and control of zoonotic infectious diseases, as well as wild animal epidemic source epidemic monitoring and exotic animal epidemic prevention, etc. Cooperation and information sharing.

The competent health department of the local people’s government at or above the county level shall strengthen the health monitoring of employees engaged in the production and operation of animals and animal products, and prevent the spread of zoonotic infectious diseases.

Article 7 Insurance institutions are encouraged to develop animal disease insurance products.

Local people’s governments at or above the county level may, through financial subsidies and other means, support units and individuals that raise animals to participate in animal disease insurance.

Article 8 Animal epidemic prevention departments of local people’s governments at or above the county level, township (town) people’s governments, and sub-district offices may carry out animal epidemic prevention work through government purchase of services.

Encourage the development of veterinary social service organizations, and support veterinary social service organizations to participate in providing animal epidemic prevention public welfare services by undertaking government-purchased services.

Article 9 The competent department of animal epidemic prevention of the provincial people’s government shall establish and improve the digital system of animal epidemic prevention, improve the construction of digital platforms such as animal quarantine, harmless treatment of dead livestock and poultry, and realize the supervision of the whole process of livestock and poultry from breeding to slaughtering.

The local people’s governments at or above the county level and their relevant departments shall encourage and support the scientific research, exchanges and cooperation of animal diseases, strengthen the training of scientific and technological talents, popularize scientific research achievements, and use information technology to carry out animal epidemic prevention work. , circulation, harmless treatment and other aspects to achieve information sharing, establish a traceability system, and improve the scientific and technological level of animal disease prevention and control.

Chapter 2 Prevention and Control of Animal Diseases

Article 10 The competent animal epidemic prevention department of the provincial people’s government shall formulate the province’s compulsory immunization plan for animal epidemics.

The competent animal epidemic prevention departments of the people’s governments of cities and counties (cities, districts) divided into districts shall, in accordance with the compulsory immunization plan for animal epidemics formulated by the competent animal epidemic prevention department of the provincial people’s government, formulate the implementation plans for compulsory immunization in their respective administrative regions, and organize their implementation.

Article 11 The competent animal epidemic prevention department of the local people’s government at or above the county level shall strengthen the management of the production, operation, procurement, storage, distribution and use of biological products for compulsory immunization by the state in accordance with the law.

Biological products for national compulsory immunization purchased by users such as farms (households) and animal clinics or obtained through government distribution are only for personal use and may not be resold.

Article 12 The competent animal epidemic prevention department of the local people’s government at or above the county level shall establish and improve the compulsory immunization assessment system for animal epidemics.

If the immunization density and immunization quality do not meet the requirements of this province, the competent animal epidemic prevention department of the people’s government of the city divided into districts, counties (cities, districts), the people’s government of the township (town), and the sub-district office shall take corresponding rectification measures according to their duties and raise Animal units and individuals shall implement the main responsibility for epidemic prevention in accordance with regulations.

Article 13 The provincial people’s government formulates and organizes the implementation of the province’s construction plan for animal disease-free areas, and determines the construction scope and the types of diseases that are subject to regional management. The people’s governments of cities and counties (cities, districts) divided into districts shall formulate and organize the implementation of the construction plans for non-regulated animal epidemic areas in their respective administrative regions according to the provincial construction plans for non-regulated animal epidemic areas.

Local people’s governments at or above the county level shall support animal breeding farms to build biosafety isolation areas without regulations for animal epidemics.

Article 14 Local people’s governments at or above the county level shall guide large-scale breeding, formulate and organize the implementation of animal epidemic purification and elimination plans in their respective administrative regions, support units and individuals raising animals to carry out animal epidemic purification, and sanitize key animals in accordance with the relevant regulations of the province. Breeding and dairy animal farms shall establish an animal disease purification system, and carry out key animal disease purification work in accordance with relevant regulations.

Article 15 Immunization against brucellosis is prohibited for breeding and dairy animals. Animals immunized against brucellosis shall not be used as breeding animals, and the fresh milk produced shall not be used as raw materials for liquid milk production.

Article 16 Live poultry trading places (trading points) shall establish and improve the system of cleaning, disinfection and market closure, and the trading venues (trading points) shall be cleaned daily and weekly disinfected in accordance with the relevant national regulations on the management of live poultry trading markets, and shall be cleaned according to the epidemic situation. The prevention and control needs to be closed.

Live animal trading venues (trading points) shall be implemented accordingly.

Article 17 After a major animal epidemic occurs, the local people’s government at or above the county level shall initiate an emergency plan and take emergency measures such as blockade, isolation, culling, destruction, disinfection, harmless treatment, and emergency immunization to quickly eliminate the epidemic , and do a good job in meat food supply, animal and animal product market supervision, and social security maintenance.

The township (town) people’s government and the sub-district office shall, according to the emergency response requirements for major animal epidemics, establish a harmless disposal site, and assist in the collection, reporting and emergency disposal of epidemic information.

Article 18 Relevant units and individuals in epidemic sites, epidemic areas and threatened areas shall abide by the regulations on the control of animal epidemics made by the local people’s governments at or above the county level and their animal epidemic prevention departments in accordance with the law.

Article 19 The local people’s government at or above the county level shall make compensation according to law for the animals that are forcibly culled, the animal products destroyed and related items in the process of animal epidemic prevention, control, purification and elimination.

Article 20 A city divided into districts shall formulate a management system for free-range livestock and poultry, establish a digital registration management system for free-range livestock and poultry, and do a good job in the epidemic prevention management of free-range livestock and poultry within its jurisdiction.

Article 21 The competent animal epidemic prevention department of the county (city, district) people’s government shall reasonably set up and announce animal rabies immunization points, and strengthen supervision and management.

Units and individuals raising dogs shall not abandon them at will. If you go out with dogs, you should remove the feces excreted by the dogs in time to prevent the spread of the disease.

A city divided into districts shall formulate dog management measures according to the actual local conditions, determine registration and management departments, establish a digital registration management system, and do a good job in the management of dog epidemic prevention in their respective jurisdictions.

Chapter 3 Quarantine of Animals and Animal Products

Article 22 Institutions undertaking animal health supervision duties may, according to the needs of animal quarantine work, employ veterinary professionals to assist official veterinarians in carrying out animal and animal product quarantine technical work, and the required funds shall be borne by the finance department at the same level.

Article 23 Units, individuals or carriers engaged in the business of animals and animal products shall transport them according to the destination indicated in the animal quarantine certificate, and shall not sell or replace animals and animal products in the middle.

Article 24 Units, individuals and vehicles that transfer livestock and poultry and livestock and poultry products from outside the province shall, at least one working day in advance, pass the provincial animal quarantine certificate electronic issuance platform or other methods determined by the provincial animal epidemic prevention department. register.

During the emergency period for the prevention and control of major animal epidemics, units and individuals that raise and manage animals across counties (cities, districts) to transfer animals and animal products related to the spread of such animal epidemics shall pass the provincial animal quarantine inspection at least one working day in advance. Registration is carried out on the electronic certificate issuance platform of the certificate of conformity or other methods determined by the provincial animal epidemic prevention department.

If livestock and poultry are transferred from outside the province or animals related to the transmission of such animal diseases are transferred across counties (cities, districts) for feeding during the emergency period for the prevention and control of major animal epidemics, they shall, within 24 hours after arriving at the destination, Report to the agency responsible for animal health supervision in the transferred county (city, district) through the provincial animal quarantine certificate electronic issuance platform or other methods determined by the provincial animal epidemic prevention department.

Article 25 Animals and animal products entering the province through road transportation shall enter through the designated passage established by the provincial people’s government, and take the initiative to accept the supervision and inspection of the designated passage inspection station.

The people’s government at the county level shall assign supervisory and law enforcement personnel suitable for the work needs to the designated passage checkpoints, and provide necessary working conditions and work funds.

Article 26 Units and individuals engaged in animal business shall establish files including animal origin, breeder, quarantine certificate number, date and quantity of purchase and sale, etc., to ensure traceability of animal information.

Units and individuals engaged in animal transportation shall abide by the designated channel system, properly preserve the itinerary and information provided by the shipper, such as the animal name, quarantine certificate number, quantity, etc., and file with the competent animal epidemic prevention department of the local county-level people’s government in accordance with relevant regulations.

Article 27 In order to control animal epidemics, the competent department of animal epidemic prevention of the people’s government at the county level shall perform supervision and inspection tasks at the existing checkpoints or express toll stations established in accordance with the law, and the public security, transportation and other departments shall provide convenient conditions. When necessary, with the approval of the provincial people’s government, temporary animal epidemic prevention inspection stations may be established to perform supervision and inspection tasks.

The specific time for the temporary animal epidemic prevention inspection station to perform the supervision and inspection tasks shall be determined by the competent animal epidemic prevention department of the provincial people’s government according to the actual situation of the animal epidemic.

Article 28 Slaughterhouses (fields, sites) shall abide by the following provisions:

(1) Establish an inspection and registration system for animals entering the factory (field, site), and only those who have passed the inspection and inspection can enter the factory (field, site). Animals from different consignors and different batches shall not be mixed in the slaughtering pen;

(2) Provide special places for animal quarantine declaration points, and equip with facilities and equipment such as official veterinary quarantine rooms and quarantine consoles suitable for the scale of slaughter;

(3) Recycling livestock and poultry labels and handing them over to the institutions responsible for animal health supervision for disposal;

(4) Cleaning and disinfecting the slaughter workshop and the slaughtering pen on a daily basis;

(5) Dispose of animals and animal products that fail to pass the quarantine inspection in accordance with regulations;

Chapter 4 Innocent Treatment of Sick Dead Animals and Diseased Animal Products

Article 29 The following animals and animal products shall be disposed of in accordance with state regulations, and no unit or individual shall dispose of them at will:

(1) Animals infected with epidemics, dying of diseases or unknown causes of death during animal breeding, slaughtering, business operation, isolation and transportation;

(2) Epidemic and diseased animal products in the production, operation, processing, storage and transportation of animal products;

(3) Dead animals and pathological tissues produced in animal diagnosis and treatment, teaching and scientific research activities;

(4) Other animals and animal products that may cause the spread of animal diseases.

Article 30 Where animal breeding farms, animal isolation sites, animal slaughtering and processing sites, and animal diagnosis and treatment, teaching and scientific research institutions conduct harmless treatment of animals that have died or unknown causes of death and diseased animal products, they shall promptly and truthfully keep records of the treatment and keep them. , the storage period is not less than two years.

The centralized harmless treatment site for animals and animal products shall record and keep the source and quantity of animal carcasses, diseased animal products, the way of harmless treatment and the disposal of products after harmless treatment in a timely, truthful and detailed manner, and the retention period Not less than two years.

Article 31 Before the harmless treatment, if it can be ensured that the relevant animals and animal products are not shipped out and animal diseases are not spread and spread in accordance with the national technical specifications for the treatment of sick animals and diseased animals, different batches of animals and animal products may be collected together. Perform harmless treatment.

Article 32 The people’s governments of cities and counties (cities, districts) divided into districts shall make overall plans for the construction of public facilities for the harmless treatment of animals and animal products, rationally arrange collection and transfer points, and establish and improve the harmless treatment system.

The centralized and harmless disposal site shall be equipped with special transport vehicles that meet the requirements of animal epidemic prevention in accordance with national regulations.

Encourage and support social capital to invest in the construction of centralized and harmless disposal sites.

Article 33 Where units and individuals have illegally produced or operated animals that died of illness, the cause of death is unknown, or infected animals and animal products, and the animal carcasses have been disposed of repeatedly or in large quantities, the local people’s governments at or above the county level and their relevant departments shall announce to the public.

Chapter 5 Animal diagnosis and treatment

Article 34 Institutions engaged in animal diagnosis and treatment activities shall obtain an animal diagnosis and treatment license issued by the competent animal epidemic prevention department of the local people’s government at or above the county level in accordance with the law, and conduct animal diagnosis and treatment activities within the prescribed scope of diagnosis and treatment activities.

Animal diagnosis and treatment licenses may not be forged, altered, transferred, leased or lent.

Article 35 Animal diagnosis and treatment institutions concurrently engage in pet supplies, pet food, and pet grooming and other items unrelated to diagnosis and treatment, and the concurrent operation area and animal diagnosis and treatment area shall be physically separated and set up independently.

Article 36 Anyone who has obtained a practicing veterinary qualification certificate and engaged in animal diagnosis and treatment and other business activities shall file with the competent animal epidemic prevention department of the people’s government at the county level where they are located.

A licensed veterinarian who issues a veterinary prescription shall be diagnosed by himself and shall be responsible for the conclusion of the diagnosis. A licensed assistant veterinarian shall assist in carrying out veterinary practice activities under the guidance of a licensed veterinarian, but shall not issue prescriptions, fill in a medical certificate and issue relevant certification documents.

Rural veterinarians shall meet the conditions prescribed by the state and file with the competent veterinary department of the people’s government at the county level where they are located.

Article 37 When practitioners of animal diagnosis and treatment institutions engage in animal diagnosis and treatment activities, they shall wear signs containing their name, photo, practice location and practice level, etc.

Article 38 Those engaged in animal diagnosis and treatment activities shall abide by the relevant operating technical specifications for animal diagnosis and treatment. The following behaviors shall not be committed:

(1) Employ personnel who have not obtained a practicing veterinary qualification certificate or have not gone through the recordation to engage in animal diagnosis and treatment activities;

(2) Discarding animal carcasses, organs and tissues or medical and treatment wastes at will;

(3) Discharging diagnosis and treatment wastewater that has not been treated in a harmless manner or that does not meet the standards;

(4) Using fake and inferior veterinary drugs, drugs and other compounds banned by the state;

(5) Using fake or inferior veterinary medical equipment;

(6) Selling or using psychotropic drugs, narcotic drugs and veterinary biological products in violation of state regulations;

(7) Failure to make medical records;

(8) Engaging in animal trading and foster care activities in animal clinics;

(9) Other acts prohibited by laws and regulations.

Chapter VI Legal Liability

Article 39 Where the provisions of these Regulations are violated, and the laws and administrative regulations have provisions on legal liability, such provisions shall prevail.

Article 40 If state organs and their staff violate the provisions of these Regulations, resulting in the spread or prevalence of zoonotic infectious diseases, the local people’s governments at or above the county level and their relevant departments shall order the responsible units to make corrections, circulate criticism and give warnings; The directly responsible person in charge and other directly responsible personnel shall be given heavier sanctions according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 41 In violation of the provisions of Article 11 of these Regulations, users such as breeding farms (households), animal diagnosis and treatment institutions, etc., who sell biological products for compulsory immunization by the state, shall be dealt with as operating without a license.

Article 42 Any violation of the provisions of Article 14 of these Regulations by failing to carry out the purification of key animal epidemic diseases in the breeding farms of breeding and dairy animals as required shall be ordered by the competent animal epidemic prevention department of the local people’s government at or above the county level to make corrections and shall be punished with a fine of 6,000 yuan. If the circumstances are serious, order to suspend business for rectification, and impose a fine of not less than 30,000 yuan but not more than 100,000 yuan; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 43 In violation of the provisions of Article 16 of these Regulations, the live livestock and poultry trading places (trading points) fail to implement the cleaning, disinfection and market closure system, the animal epidemic prevention department of the local people’s government at or above the county level shall order it to make corrections within a time limit. Those who make corrections shall be fined not less than 2,000 yuan but not more than 10,000 yuan; if the circumstances are serious, they shall be ordered to suspend business for rectification, and shall be fined not less than 10,000 yuan but not more than 50,000 yuan.

Article 46 In violation of the provisions of Article 24 of these Regulations, the transfer of livestock and poultry and livestock and poultry products across provinces fails to register within the specified time, or the transfer of livestock and poultry for breeding fails to undertake animal health supervision to the transfer place. If the responsible agency reports, the competent animal epidemic prevention department of the local people’s government at or above the county level will give a warning and impose a fine of not less than 5,000 yuan but not more than 10,000 yuan; if the circumstances are serious, a fine of not less than 10,000 yuan but not more than 50,000 yuan will be imposed.

In violation of the provisions of Article 24 of these Regulations, during the emergency period for the prevention and control of major animal epidemics, the transfer of relevant animals and animal products across counties (cities, districts) has not been registered within the specified time, or the transfer of relevant animals for raising unsuspected animals. If it is reported to the agency responsible for animal health supervision in the transfer place, the animal epidemic prevention department of the local people’s government at or above the county level shall isolate, seal up and dispose of the transferred animals and animal products. If the circumstances are serious, a fine of not less than 30,000 yuan but not more than 100,000 yuan may be imposed.

Article 47 Those who violate the provisions of Article 28 of these Regulations by failing to provide a special place for animal quarantine declaration points, or not equipped with facilities and equipment suitable for the scale of slaughtering, shall be ordered by the competent animal epidemic prevention department of the local people’s government at or above the county level to make corrections Those who refuse to make corrections or are still unqualified after making corrections shall be ordered to suspend business for rectification.

Those who violate the provisions of Article 28 of these Regulations by failing to collect livestock and poultry labels and hand them over to the institutions responsible for animal health supervision shall be ordered to make corrections by the competent animal epidemic prevention department of the local people’s government at or above the county level, and a fine of 500 yuan to 2,000 yuan may be imposed. Violating the provisions of Article 28 of these Regulations by transporting animals to be slaughtered in factories (fields, sites) out of the factory (fields, sites), the competent animal epidemic prevention department of the local people’s government at or above the county level shall order it to make corrections and impose a fine of 2,000 yuan A fine of not less than 10,000 yuan but not more than 10,000 yuan; if the circumstances are serious, a fine of not less than 10,000 yuan but not more than 30,000 yuan shall be imposed.

Article 48 Violating the provisions of Article 35 of these Regulations, and the concurrent operation area and the animal diagnosis and treatment area have not been physically separated and set up independently, the animal epidemic prevention department of the local people’s government at or above the county level shall order it to make corrections and give a warning; Those who do not make corrections or are still unqualified after making corrections shall be fined not less than 2,000 yuan but not more than 10,000 yuan.

Article 49 Violating the provisions of Article 37 of these Regulations, if the employees of animal diagnosis and treatment institutions do not wear signs as required when engaging in animal diagnosis and treatment activities, the competent animal epidemic prevention department of the local people’s government at or above the county level shall order them to make corrections and give them a warning; Those who refuse to make corrections shall be fined not less than 200 yuan but not more than 1,000 yuan.

Article 50 If an animal diagnosis and treatment institution violates the provisions of Article 38 of these Regulations and employs personnel who have not obtained a practicing veterinary qualification certificate to engage in animal diagnosis and treatment activities, or engages in animal trading or foster care activities in animal diagnosis and treatment sites, the local people at or above the county level shall The competent animal epidemic prevention department of the government shall order corrections, give warnings, and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan; those who refuse to make corrections shall be fined not less than 50,000 yuan but not more than 100,000 yuan.

If practitioners of animal diagnosis and treatment institutions violate Article 38 of these Regulations and fail to make diagnosis and treatment records, the competent animal epidemic prevention department of the local people’s government at or above the county level shall give a warning and order them to make corrections; Animal diagnosis and treatment activities under the age of two years.

Article 51 These Regulations shall come into force on October 1, 2022.
